These Terms and Conditions govern the use of www.labopure.fr and consumer purchases made directly through the website.
They apply to the exclusion of any other terms proposed by the customer, except where mandatory law provides otherwise.
Orders placed for professional, wholesale, resale or distribution purposes may be subject to separate written terms.
Acceptance of the Terms
Before placing an order, the customer must be able to review these Terms and correct any input errors.
By submitting an order with an obligation to pay, the customer confirms that they have read and accepted the Terms and Conditions of Sale, the Return Policy and the Refund Policy applicable on the date of the order.
Acceptance of these Terms does not waive or restrict any mandatory consumer right.
A copy of the order confirmation will be sent to the email address supplied by the customer.
Customer eligibility and account information
Customers must have the legal capacity to enter into a contract.
The customer is responsible for providing complete, accurate and up-to-date billing, delivery and contact information.
LaboPure cannot be held responsible for a delay or failed delivery caused by incorrect or incomplete information supplied by the customer, without prejudice to mandatory legal rights.
If a customer account is created, the customer is responsible for maintaining the confidentiality of the account credentials and for notifying LaboPure of suspected unauthorised access.
Product information
LaboPure takes reasonable care to present accurate product names, descriptions, quantities, ingredients, instructions, precautions, prices and photographs.
Customers must read the complete product information, ingredient list, instructions and warnings before purchase and use.
Images are provided for presentation purposes. Minor differences in colour may result from lighting, photography, screen settings or reasonable packaging updates. Such differences do not affect the customer’s rights where the delivered product does not conform to the description or order.
Packaging and product information may be updated where necessary, provided the essential characteristics of the ordered product are not materially changed without informing the customer.
Product availability
Products are offered subject to availability.
Adding a product to the basket does not reserve it. If a product becomes unavailable after an order has been placed, we will inform the customer as soon as reasonably possible and refund any amount paid for the unavailable product.
We may limit quantities where reasonably necessary to prevent fraud, unauthorised resale or stock abuse, provided this does not affect an already accepted lawful order without valid reason.
Prices and taxes
Prices applicable to an order are those displayed when the order is submitted.
For sales to consumers in France, prices are displayed in euros and include applicable value-added tax unless clearly stated otherwise.
Delivery charges and any other applicable costs are displayed before the customer confirms the order.
Prices and future promotions may be changed at any time, but changes will not apply retroactively to an already confirmed order.
In the event of a manifest pricing error, we will contact the customer before dispatch to offer the choice between confirming the order at the correct price or cancelling it for a full refund.
Orders
The customer can review the selected products, quantities, delivery information, total price and applicable charges before submitting the order.
After an order has been placed, the customer will receive an electronic confirmation containing the main order information.
We reserve the right to refuse or cancel an order on legitimate grounds, including:
* payment authorisation failure;
* confirmed product unavailability;
* manifest pricing or technical error;
* incorrect or unverifiable customer information;
* reasonable evidence of fraud;
* abusive purchasing behaviour;
* suspected unauthorised resale.
If a paid order is cancelled by LaboPure, the corresponding amount will be refunded.
Payment
Available payment methods are displayed during checkout.
Payment must be authorised before the order can be processed. Payment services may be provided by secure third-party payment providers.
LaboPure does not retain complete payment-card details when those details are processed directly by an authorised payment provider.
The customer confirms that they are authorised to use the selected payment method.
Promotional offers and discount codes
Promotional offers are subject to the conditions and validity period displayed with the offer.
Unless otherwise stated:
* only one promotional code may be used per order;
* a code cannot be exchanged for cash;
* a code cannot be applied after an order has been placed;
* a promotion applies only to the eligible products and territory stated;
* discounts may not be combined.
Promotional offers do not restrict statutory consumer rights.
If products purchased as part of a bundle or conditional promotion are partially returned, the refund may be recalculated according to the price that would have applied to the retained products, provided this method was clearly disclosed with the promotion.
Delivery
Products can be delivered only to destinations offered during checkout.
Available delivery methods, charges and estimated delivery times are displayed before the customer submits the order.
The estimated delivery period begins once the order has been accepted and prepared, unless a different starting point is clearly stated during checkout.
We will deliver the order on the date or within the period communicated to the customer, except in circumstances permitted by applicable law.
The customer must provide an accessible and accurate delivery address. Where the carrier cannot complete delivery because of incorrect information or the customer’s failure to collect the parcel, reasonable reshipping costs may be requested, without affecting mandatory rights.
Transfer of risk
For consumer orders, the risk of loss or damage passes to the customer when the customer, or a third party designated by the customer other than the carrier, takes physical possession of the products.
If the customer independently chooses a carrier that was not proposed by LaboPure, the applicable statutory rules concerning transfer of risk will apply.
Delayed, lost or undelivered orders
If an order is delayed beyond the delivery period communicated during checkout, contact us at info@labopure.fr.
We will investigate with the carrier and provide the remedies required by applicable law.
A customer should not be required to resolve a confirmed loss directly with the carrier where LaboPure remains legally responsible for delivery.
Right of withdrawal, returns and refunds
The statutory right of withdrawal and the procedures for returning products and receiving refunds are described in Sections 2 and 3 above.
These contractual policies do not limit statutory consumer rights.
Legal guarantees
Consumers benefit from all mandatory legal guarantees applicable to their purchase.
Under French law, this includes in particular:
* the legal guarantee of conformity under Articles L.217-3 and following of the French Consumer Code; and
* the legal guarantee against hidden defects under Articles 1641 and following of the French Civil Code.
For new goods, the seller is liable for defects of conformity that appear within two years from delivery, in accordance with the conditions provided by law.
These legal guarantees apply independently of the Return Policy and cannot be excluded because a product was opened where the claim concerns a genuine defect or lack of conformity.
To submit a legal guarantee claim, contact info@labopure.fr and provide the order number, product concerned and a description of the issue.
Cosmetic and product-use precautions
LaboPure products must be used only for their intended cosmetic or personal-care purpose and in accordance with the instructions and precautions provided with the product.
Before use, customers should review the complete ingredient list and avoid using a product containing an ingredient to which they have a known sensitivity or allergy.
Where recommended, perform a patch test before broader use.
Avoid unintended contact with the eyes or other sensitive areas unless the product is specifically designed and instructed for that area.
Discontinue use if persistent irritation or an adverse reaction occurs and seek appropriate medical advice when necessary.
Cosmetic products are not intended to diagnose, treat, cure or prevent disease. Individual cosmetic results may vary depending on skin type, usage and other personal factors.
Nothing in this section excludes liability or consumer rights that cannot legally be excluded.
Misuse and prohibited website activities
Customers and visitors must not:
* use the website for an unlawful or fraudulent purpose;
* attempt to gain unauthorised access to the website or another customer’s account;
* interfere with the website’s security or operation;
* introduce malicious code;
* copy or commercially exploit protected website content without authorisation;
* submit false, misleading or abusive information.
We may restrict access where reasonably necessary to protect the website, customers or company, subject to applicable law.
Intellectual property
The LaboPure name, logos, packaging designs, photographs, texts, graphics, product presentations and other website content are protected by applicable intellectual-property laws.
No content may be reproduced, distributed, modified or commercially used without prior written authorisation, except where permitted by law.
Liability
LaboPure remains responsible for the proper performance of its legal and contractual obligations.
To the extent permitted by law, LaboPure is not responsible for losses caused solely by:
* use of a product contrary to its instructions or warnings;
* unauthorised alteration of a product;
* incorrect information supplied by the customer;
* unforeseeable events outside LaboPure’s reasonable control;
* incompatibility or allergy that could not reasonably have been identified, where complete and accurate ingredient information was provided.
Nothing in these Terms excludes or limits liability for fraud, wilful misconduct, personal injury caused by negligence, defective products, breach of mandatory consumer law or any other liability that cannot legally be excluded.
Force majeure
Neither party will be liable for a delay or failure caused by an event qualifying as force majeure under applicable French law.
The affected party will inform the other party as soon as reasonably possible. If the event prevents performance for an excessive period, the customer may exercise the remedies available under applicable law.
Personal data and cookies
Personal data is processed in accordance with the LaboPure Privacy Policy.
Cookies and similar technologies are managed in accordance with the LaboPure Cookie Policy and the choices made through the website’s consent-management system.
The Privacy Policy and Cookie Policy are separate documents and form part of the website’s legal information.
4.21 Third-party services and Amazon purchases
The website may contain links to Amazon or other third-party services.
LaboPure is not responsible for the independent operation, privacy practices or website content of a third party.
Where a product is purchased through Amazon, the order, payment, delivery and initial return request must be managed through the relevant Amazon account and order interface.
This clause does not affect any mandatory right that a consumer may have against the applicable seller or manufacturer.
Governing law
These Terms are governed by French law.
This choice of law does not deprive a consumer residing in another country of any mandatory protection granted by the law of their habitual residence where that law applies.
Any dispute will be submitted to the competent courts determined under applicable mandatory rules. Nothing in these Terms requires a consumer to bring a claim exclusively before a court that would not otherwise be competent.
Complaints and consumer mediation
Before requesting mediation, customers should first send a written complaint to:
info@labopure.fr
If the complaint cannot be resolved directly, the consumer may use approved consumer mediator.
The mediator may be contacted only after the customer has first attempted to resolve the dispute directly with LaboPure and subject to the mediator’s eligibility rules.
Changes to these Terms
We may update these Terms to reflect legal, operational or website changes.
The Terms applicable to a purchase are those accepted by the customer on the date the order was placed. A later amendment will not retroactively modify an existing order.
The date of the most recent update appears at the top of this page.
